If I am reading the situation correctly, BMW (the company, not the dealership) is saying that they have no record of an extended warrantly in effect on this car.
So, a more analogous situation would be if you bought, say, a spare tire for your car. You drive off the lot and the next day the dealer calls you and tells you that there is, in fact, no spare tire in your trunk and they are sorry and will give you your money back. The advice to just ignore the dealer will inevitably lead to your needing that "spare tire" and when you do you will realize that it does not exist. So, you may very well have purchased the warranty (spare tire) but the dealer never delivered it to you! You have two options: 1) Force the dealer to purchase, from BMW, the agreed upon and paid for extended warranty. If they won't and this is your choice, you may have to file a lawsuit. I'm struggling to understand why the dealer doesn't just deliver the warranty (understand it is an intangible thing, a contract, and they never really deliver anything). 2) Go pick up your refund. I'd agree that they should give you the full MSRP and adjust the profit on the car. It was a package deal and economically it looks a lot like a bait and switch. Ok - there is a third option - you could insist that they refund the purchase price of the car and you walk away. Of course, if you do that you won't have the car. Do you want that? Didn't think so! |

Assuming you have this deal in writing; I'd start with talking to the dealer. If he doesn't give the promised warranty then suggest possible legal action. Keep in mind if the dealer doesnt give in he will ask you to leave and all lines of communication with the dealership will be over. At this point you formally complain to BMW NA. And after they dont resolve the issue you go the expensive route of suing. It will likely be more expensive than $500 to sue so taking a refund and buying the warranty at another dealership will be cheaper and less hassle.
It shouldn't have to go that far over a warranty that the dealership is only loosing $500 off MSRP (your deal). I've got to imagine the markup on extended warranties is huge and they are still making a couple bucks even at $500 off. You may be enough nuisance that they will resign to not making a big profit on the warranty just to make you go away. After this is all over I would look into a new dealership. I wouldnt feel comfortable taking my car for service at a place that tried to screw me and that I had to threaten civil action. Whatever you do, dont ignore this. Worst advice ever (sorry to those that suggested). The dealer notified you about this issue now. Depending on your state the statute of limitations for legal action most likely will have expired in 4 years. Ignoring this could leave you with no refund, no warranty and no recourse. |
