Ok after reading this post I realized that I picked my car up from a hotel where I valied the car. However, after I picked up the car I got on the freeway and was going easy 70MPH for about 3 miles till gas in my car cut off. Lets say the car was over revved; wouldn't the car have broken down right away?

Presumably if the DME report has the exact RPM you hit, it may have the time/date stamp of when it was hit. If you can tie it into when you had your car with the valet, you may be able to attribute any damages to the hotel.

A friend of mine had his E36 M3 grenaded by a valet, almost exactly the same situation. he valet'd the car, picked it up and it died on his way home..

i wonder if the DME report has time/date logging.. if so, you have a hotel to sue.

The DME report absolutely will have the time and date information for any recorded events, just like the fault codes which have time, date and odometer info.

Wow. That sucks. There was a giant thread on bimmerforums about a guy with an E46 M3 that had a spun bearing because the dealership guy ran the hell out of the car. It was a long process until it was proven the dealership was responsible.

Whenever I end up valeting my car, I always slip a little extra cash to the guy to keep it up front or close so that they don't have to drive the car anywhere.

They ceratinly did, a whole bunch of years ago. It's commonly called an AUTOMATIC TRANSMISSION.

wow valet! damn those fools....I hope you can catch them if thats the case...at least there is one good thing that can come out of the DME time/etc....just make sure you have ur valet ticket or something or proof of hotel stay etc get all that stuff together now while you still can.

btw I try and avoid valet's as much as possible, cuz I just dont trust anybody with my car...lol even when I was in high skl with my camry...I guess I just love my cars to much regardless its brand

Wow, three miles after the valet, the engine let's go! I'd focus all your attention on the hotel/valet. Have the dealer get you the exact date/time of the overev and also how much your cars clock is running slow/fast compared to official US time...all on dealer letterhead. It will come down to proving the car was in the hotels possession at the time of the over rev. Hopefully slubu can help u out! Good luck!

they'll be able to tell you all the pertinent data related to the event...
time, date, duration of the exceeded rpms, road speed, temp, etc.

it would be great if it showed a sudden decrease in road speed, in relation to engine speed -- thats normally a sign of a missed shift --
(into a lower gear)
