i did take pictures and she does have AAA insurance. But from her tone of voice, doesn't seem like she'll admit its her fault so I might have to pay the deductibles... guess I have to go see my lawyer tomoro and report my 'headaches' when i 'ram' my head into the windshield when she back into me.

ps. jw, who's fault does this looks like?

yup, looks like you got out first, then she backed out into you.

she must be one of the drivers who back out from parking without looking behind.

apparently, cause she continued to back out even after I honked. Now I learn that honking doesn't work in situations like these. i'm not even mad about getting hit.. i'm more mad about I can't drive my car to SD next week.

well if you weren't moving, it's hard for her to make a case. what's the damage control?

^ don't know yet, just happened within 12 hours so insurance hadn't had a chance to take a look at it and by the time I tow it to autobody, they were already closing. (couldn't even drive the car cause the fender would keep rubbing the tires)

but its ok, I think I'll be fine with lawyer j's help

well, that's why you need to install a horn blowing from your ass. since when you were blowing your horn the sound directs toward the front and she was behind you.

This was an act of negligence by the other driver ("DRIVER"). DRIVER owed a duty to act as a reasonable driver. DRIVER breached this duty by failing to look behind and around her vehicle as a reasonable driver should and would have done before backing out. But for DRIVER's actions, you would not have been hit. DRIVER's actions were the direct cause and created a foreseeable risk of harm. Therefore, DRIVER was negligent as she owed a duty to you, breached that duty, and was the actual and proximate cause to your injury.

Although you owe a duty to yourself to act as a reasonable driver also, you did not breach this duty because you were paying attention and could not have reasonably anticipated another vehicle would suddenly reverse while you had already fully backed out. There was no way you could have prevented this accident. You are not contributorily negligent.

I'm just explaining what the likely argument will be. BUT, your lawyer will do all that for you. All you have to do is just calmly state that you were already fully backed out when the other driver hit you.
aw f***...too much reading early in the morning.....
