Yep, throwing in phrases like "rebuttable presumption" shows a tremendous amount of intelligence. Yet, misapplying that term does not. it is BMW that has the "onus" or, in plain English, the burden of proving that CEA has installed the mod that "allegedly" caused the fuel pump failure. Mods = OK unless there is a causal connection between the mod and the defect in the car's part. Just proving that CEA "ordered Xede" gets BMW nowhere.

The best thing to do when the dealership asks the ECU question is just play dumb:
"Um sir, have you modified the ECU in any way?"
"No, I haven't done anything to the seats"

If you can say it with a straight face I think it will clear all of the dealer's doubt.

Why the fuck did they look at the DSC for car running poorly? Thats the biggest idiot I know of. If the DSC is screwed up, it throws the SZL light and the DTC symbol and all that jazz.

Wheel speed issues? Wow whoever worked on it must not know his head from his ass...so lets see...car has CEL, so lets throw it up on a lift and check the wheep speed sensors to find out you have 'race' tires and suspension and exhaust!!!....

Car running poorly...they didnt bother to check the MAP readings, or maybe check fuel pressures or any of that? wow.

Are you refering to post 97 and 99?

There are 2 points here that can void the warranty, first the xede, second, the "racing".

If BMW has to prove that he installed xede (which he indeed did), there are just as many posts from CEA3 to show that he "got the xede" and "installed the xede". Unless of course, they would then need to prove that CEA 3 was the one composing all these post. In the end, it would just be another "proof it" loop?

Regardless of the above paragraph, CEA 3 did mention he brought the car to the track (and reported times on this forum nonetheless). IF whatever composed under the name of CAE 3 can be used against him, he doesnt even need to worry about the xede/proceed issue anymore, because the track incident(s) would have been enough to deny all warranty claims.

edited to add that the people taking bmw's side on this one are insane.
its a manufacturing defect, plain and simple.
there are warrenties for things like this and they have an honor to uphold that. not to try and weasel out of it by blaming it on a chip.

just bc they MIGHT be able to get out of fixing it bc of the fine print, doesnt mean they should. its obvious to any mentally competant person that they are trying to get around fixing a flaw in their engineering/manufacturing.
