well it wouldnt be in his best interest to miss those repairs, its more money in his pocket....this is just a case of negligence

no...if he caught those damages and fix them....
it should be out from BMW's money....no liability for him....his job is to catch all the defects before deliver to customer....

the only reason i can think of that he will delibrately miss those damages....was that he took the car and went for a joy ride....

What i meant by that is that he didn't put down the damage on paper hoping to pushing the blame on the customer
