Anyone have any info on this new catless dp law

Heard today from a BMW indy that if you are caught running a catlees dp your car can be seized!

Anyone else heard anything about this?

Roadside checks

Your vehicle can also be tested during a roadside check.

If it fails the check, you’ll be given a prohibition notice. You’ll have 10 days to fix the problem. If you don’t fix it within this period you may be prosecuted.

If your vehicle is seriously in breach of the legal emission limits, or if it has other defects which make it dangerous, the notice will come into effect immediately. You won’t be able to use the vehicle. You may also be prosecuted.


I believe it is also prohibited to modify any part of an exhaust system that impacts emissions.

But kind of a red herring as the n54 still passes emmissions after catless dps.
i wonder how that will be viewed?

you will need at least the secondary cats... if you have complete catless system it won't pass unless the MOT tester aren't doing the job properly

This has been brewing for ages. I posted a good few months ago re VOSA change in stance on certain things, especially if you're a diesel car user with the usual DPF delete, I've seen the bulletins from VOSA re tweaks happening here and there re emissions there's certainly a tightening of belts coming, the N54 type question will all boil down to a degree how far you've gone completely Catless does open up a can of worms, primary cats removed and the car being hot(roadside test it'll be hot)should enable the car to pass but perhaps only just

Stepping sideways slightly the one emmission type tweak in terms of attitude change may come to those with diesels and DPF delete, with Nox being a very hot topic at the moment there have been several clear warnings re the ramifications of either doing a DPF delete or knowingly getting a car through the MOT with a DPF delete of some kind in place from VOSA, we for instance simply will not get involved in this sort of thing for diesels, the rules are as we know re the test are geared towards a smoke test, that's it re passing the MOT, these rules in the current climate and re the hot Nix Oxide emissions subject may/could well be altered in the future as VOSA move the goal posts to update their testing requirements to meet updated views re Nix Oxide emissions, plus they may well tighten things up to effectively snare more "offenders in their net" who carry out the DPF delete to kerb something that they know exists? Who knows

Its always been the case that they can prohibit your car for things like this.

I guess its all discretionary though. If they stop you, and the car doesnt meet emissions because the cats are broken (older car say) then they're unlikely to sieze/prohibit it, they'll instead give you a rectification notice and send you on your way.

If however its clear that you've deliberately modified the exhaust by removing cats, and it doesnt pass, then they could ofcourse choose to prohibit the car to "teach you a lesson".

So long as you have a cat in the exhaust (or a pair in a dual system), and they are in good working order, you'll pass the emissions just fine. A 335 has lots of cats, but many cars dont, and still just have one, and those cars have to meet the same emissions targets that a 335 does. Older cars had the cats mounted under the car, newer stuff tends to have it hung right off the manifold, but thats just to get them up to temperature quicker.

Well hopefully its BS as having a Miltek catless dp fitted Saturday.
