After the software upgrade THIS came back. Has this happened to anyone else? If so, is there a way to get rid of it or has BMW screwed us again?

That has been there for me even with prior versions. It’s very annoying that it doesn’t go away after a few seconds.

OK I figured it out. For some reason, unbeknownst to me, my Bimmercode App was not recognizing that I had purchased the full version and hence the headunit contrpol module was not being displayed. The head unit module controls the B&W sound and legal disclaimer on start up. So all is good again.
