F36 440i had a aftermarket tune on the car when I drove off the lot, didint know at t

I currently own a 2019 440i and bought this car in July of 2023. At the time I didint know, but the car had and still has a stage 3 xHP tune on it. It was there the day I drove off the lot. Would I be eligible for some kind of price reduction or money back?

Doesnt bother me. Just trying to see if I can make a quick buck off it, also the previous owner had other OTS maps too

Unless they documented in the paperwork that it specifically did NOT have a transmission flash then I'd imagine you're SOL.

That's like arguing it had an aftermarket part. So what, it's a used car. The best you could hope for I guess is them flashing it back to stock settings.

How did you find out about the flash?

Strange how things work in the States...

With an unapproved modification of any kind which is not registered in the paperwork, one invalidates the roadworthiness of a vehicle in Europe. Hence the previous owner sold a non-roadworthy vehicle, without declaring it, which is a crime. This is how it would work in Germany and most other countries around.

This is not the same as replacement of parts with non-OEM parts as long as they are considered analogue alternatives to the original ones (CE-marking).

(Even knowing the car HAD a tune and not declaring it when selling is considered a fraud...)
