Help - Summons Opinion
Guys, need a little advice. I was picking up the wife over at JFK last week, if any of you are familiar with the area before you hit the JFK expwy vehicles usually park on the shoulder awaiting for whom ever they're picking up to land.
Cops pulls up behind me, asking me what I'm doing parked here. "I said just got here, waiting for my wife to land, leaving soon, also stopped to call her to confirm if plane landed or not". He says this shoulder is only for emergencies and gives me a ticket for "failed to obey traffic device." Over $200 with fees! Can i fight this or just pay? Points? There are no traffic devices, signs but no device. I can use this as an argument, also there were 8 cars in front of me and he didn't harass any of them, just kept going. Thanks! |

Sorry to hear about your ticket. It was the end of the month and I guess cops have to make their quota. I dont believe that is a moving violation so no points. but you should check online.
I would just pay if there are no points, I usually just make my rounds or stand at the departure area till Im asked to move. Shoulders are really for emergencies and I find it annoying to have a whole caravan of cars waiting there. (just sayin') Its dangerous. GL. |

i know exactly where you're talking about. I work at JFK. I don't understand why people choose to wait along the side of the highway in the first place. Its dangerous. Not only that, there is a FREE parking lot (cell phone lot, is what they call it) for you guys to wait for passengers. Honestly there should be more policemen patrolling JFK expressway because the stopping and going into the emergency lane messes up traffic.

Failure to obey a traffic signal is a 2 point offense, it was for me on the RFK bridge.

Didn't write down the reason, just says "failure to obey traffic device". Does a sign constitute as a device? He did ask if it was an emergency, i said no. I'm more than happy to lie , do you they take down notes? Don't want him telling the judge that i confirmed that it wasn't an emergency.

Sorry to hear that brotha, it is the end of the month so theyre try to make that quota. Theres another place where you can wait - they have a designated parking lot when you get in to the airport and free too. I dont know exactly but you should able able to see it before you get to the terminal signs.
