hey wusup guys... well i was supposed to get a 08 e92 i went to the dealer got a quote set, down payment and monthly pay set. so he told me he was going to order it and i gave him a deposit. this was back in june 29. like a couple of weeks go by and he sends me an email saying that they couldnt find anymore 08 allocations and that i might have to wait for an 09 but he was still trying to get me the 08. now am getting an email that says that management wasnt to know since there are no more 08 allocations am i willing to accept the new lease rates and all this bullshit(pardon my french). can they do this even though i already gave my deposit and i signed some papers that said what my monthly pay was going to be and that i was geting an 08. i dont think that they should of made me do all this if he knew he didnt have anymore 08 allocations. what do you guys think i should do. do you think that they would let me keep the same deal they gave me?
i ordered an e92 AW/CR aluminum trim 6MT sport package.

you should be able to get your deposit back np, if they cant order the car you want. if they can give you the exact price for an 09' then i dont see why you wouldnt accept that. if they try to up the cost though, i would get my money back and start negotiating from scratch.

dont you think that they should let me keep the same deal tho... is kinda their fault that he thought they had 08 allocations... i signed a paper and everthing and i got letters home saying thank you for your purchase... i really dont know what to do... i guess wait till the officicial MSRP comes out

not true. He signed for an 08...since there are no 08's available to order I'm sure he'll be able to get his deposit back. Even if they tell him no, the dealer can't hold the deposit (they'll lose in court every time).

Like the above posters said, get your deposit back if they can't get you an 08 car and negotiate on an 09 model.

It sucks that they couldnt deliver on the 08, but its not possible to give you the same deal on the 09 model since the rates residuals MSRP's and costs are all different.

Start from scratch.

if u wanna start from scratch hit up autocouture above, he put together a sick deal on a 335 for me but i had problems, n it was also the 2-3 days before the 08's were going to stop production so i just bought an evo x, couldnt settle for the 328, needed power..n i got it haha!

nope. no way. the paperwork says 08 not 09 so he doesn't have any leverage on them in that regard. legally they are obligated to do the deal on an 08 not an 09. if they cant deliver, they refund his deposit.

just spoke to the CA friday and am going with the 09....i just hope that they give me a good deal for making me good through all this bullshit....now i have to go back to the deal and fight over the price again. plus i know the general manager and hopefully he wont screw me over

i know lets cross out fingers and hope for the best... if everything goies out good i should be getting it round the first week of august. ive been waiting since june 29th
