It's a bit hard to tell from your photo, but it may just be that the paint has been scraped off allowing a small amount of surface rust to accumulate.

If that's the case, you can fix this by properly preparing the surface and painting the damaged edge. Given its location, if is done carefully, your touch-up may not even show. If the rest of the car looks great, or you are not a handy, detail-oriented person, consider having it done professionally.

That's the first time I've seen rust on an E90.

E46s is a different story.

That looks like the inside of the arch, like a tire/wheel has rubbed on it. It looks like it's just surface rust, you should be able to remove any rust with an scotch brite pad or something similar, then just treat it with some rust prevention stuff or even spray some self etching primer and then a top coat to seal it.
