I'm not sure about the American banking setup but the bank has to take some responsibility for this if they've claimed that the details and cheque are kosher.

That's exactly what I was thinking - he's gone ahead with the sale on the back of the bank stating that it was all clear & above board

Cashier's check (cheque, even, I'm an ex-pat) scams are rife in the US, and the banks seem remarkably incapable of dealing with them. I've seen this with cars, high end firearms, and even homes.
