Should assaulting public servants be treated as a felony?

I was talking with a teacher friend of mine last night and she was telling me about how she wants out because she has no power to scold students. She deals with many unruly and physically abusive kids and it's getting worse. Young students, little parent control, state's stance is student is always in the right, can't suspend them or remove them because it's limiting there ability to learn and against the rules (not sure if that's law or just school). She said the only was to get a student disciplined or removed it through police interaction. Every day she's spit on, punched, kicked, verbally assaulted, etc. And she just has to take it and continue on. I wouldn't put up with it personally. But she's one tough lady and the good kids make it worth it I guess.


I'd thought, well why should it only be assaulting police that's treated as a higher crime than the average citizen? Why shouldn't we extend that to all public service workers? Emergency staff have to deal with just as much if not more, teachers assaults are growing more violent every year it seems, child protection workers I would think are not immune, etc, etc. All careers that are understaffed. If there where more protections for these people maybe those positions could be filled better. And even if not, there service should be noted and held to a higher level of crimes against for their work.

We've done a terrible job shielding our youth from the internet and smart photos. Might seem inacuous to those of you who aren't parents of kids, but I have a son in middle school and elementary school. You can spot the kids who are on smart phones by the way they carry themselves almost. Giving the world access to our children is the stupidest choice a parent can make. The amount of garbage online that a kid can click on should scare us. Then they go to class and think - I'm just like an adult, since they have been watching content that is often not suitable for adults. Disrespectfulness, rudeness and entitlement. But there is so much profit in monetizing our youth, our capitalistic ways are too strong to collectively come to an agreement that no kid should have a smart phone under the age of 18.

Side note: Our childs first period teacher took their life during week 2. He was drawing pornographic material and selling it on his etsy page which was linked to his FB page. He was a graphic arts teacher. Graphic indeed. The kids could access the page and so could the adults. It was images of satan - horns and all - in various sex positions with a big fat lady. Very twisted weird art, I can tell you that. He was the one teacher my son said seemed off when we talked about his new experience at school. This is one of the top art schools in the area kids and parents love. Yes I spoke with the principle, who told me what the teachers do on their own time is up to them, and that the school was similar to Austin Texas, blue surrounded by red.... yikes.

Teachers, schools, they need our prayers. Turn a blind eye to that if you want, but they desperately need Holy intervention as far as I'm concerned. Any kid who is stopping the class from being able to focus should have to go to the office and talk to the Admin.

I'm right there with you on this - it has been a rather rapid descent, but we are culling the quality people out of the core professions that form the fabric of society - police, medical/first responder, teaching, clergy, press, science (farmers and small businesses too, but not as directly from this issue). Front-liners have always been getting spit on and mistreated, but when you don't get any support, validation, or protection it will wear anybody out. Then all you have left are the people who took those jobs for the wrong reasons (that art teacher isn't going to mind a little classroom misbehavior to keep such a cozy and fulfilling position).

And as an aside, I think it should be a felony to assault ANYBODY physically, or to threaten serious violence. Along with a justice system that will actually stand behind penalties. But if you show people a world where society is too lazy, cheap or hypocritical to actually stand behind the laws, then you are basically telling them it isn't important and they can do whatever they want.

In Idaho they are allowed to hit your child legally in school....

Dealing with a few issues of discrimination & hate towards kids in Elementary school, how the principal, school, district, etc is handling it, finding out about many other similar or worse examples in the school. There is a very serious problem with children, parents, and schools these days. No one will or can do anything to solve the problem, and most parents are blind to what is actually going on within the school walls.

I don't understand, They are clearly doing illegal things, call the police and let them handle it?

And you can punish kids others way as well. Feel like the teacher is lacking here. Like the teacher doesn't have to allow this. She can call the police every time it happens and wait. Management will catch on.

Sure that is the source of all our issues Cracks me up every time.

My friend you are arriving at such a false conclusion based on survivorship bias (correct me if the term is wrong). What about all the families that are like that, yet aren't successful and failed and have bad kids in school? Now we conveniently disregard those ?

I'm a product of a fatherless home and people tell me I turned alright.

Some people would say the moral fabric of society is degrading for which there are numerous contributing factors. On the flip side, every generation has had the sentiment that "these kids" aren't alright.

Just prosecute the laws that exist already and stop slapping hands and saying it's a bad thing you did there and get off Scott free!

A special Class of Citizen is not needed! Sorry! But NO to any special designation of escalation in charges because of what a person's job is. Again, laws already exist for Assault!

Schools also have been given wide berth by the SCOTUS in interest of Student Safety to allow for administrators to basically have free reign to institute rules that are more stringent than even what law allows in regard to searches, trespassing, etc. Not sure why adminstrators then are so reluctant to punish students who break not only rules, but law! Any assault on an employee should result in expulsion, end of story, and follow up with local LE for arrest and charges be filed. Zero tolerance!

When miscreants learn there are consequences for their actions, they'll think twice. When they get away with stuff, let alone repeatedly, is when issues occur.

But if we create special laws for special class of people's, what's next? Special laws for the Hot Dog guy? Sanitation man? Etc. No... Just no!

My previous employer is an IT contractor that supports schools all throughout New England.

You can thank shitty parenting and lawyers for the current state of our schools. School board of eds and administrators have their own issues, but they are all scared to death of the parents. There are too many kids labeled "special needs" who really just have behavioral problems and need a swift kick in the ass. Kids who were never told "no" by their parents, and you can bet the minute the kid is disciplined by the school the parent will have a lawsuit ready with their mile long list of disabilities they claim the child is suffering from.

The kids can assault teachers, administrators, and other students and nothing will be done. Many of the teachers I worked with while in my previous role have actually left teaching and a lot of the schools have a teaching shortage which I don't believe will change until some serious changes are made.

I can tell you from experience that teacher will be considered "not a team player" and something will happen where they suddenly don't work there anymore. Administration and board of eds don't want the negative attention especially on social media. Not to get political, but many of the school shooters have a long list of red flags that were always ignored by the school districts because of "special needs" immunities. Kids who are truly special needs deserve to get the help they need, but the system that decides how these kids are labeled, and what qualifications need to be met for them to get this treatment is severely flawed.
