Hello, I was thinking about buying e92 335i in individual Dakar Yellow II, I found out that the car has MHD Stage 2 license for it and the seller says that he never put it on. Is there a way to find out if it has actually been applied? The car has aftermarker intercooler, downpipe and chargepipe so this was the first reason i was checking if it had been tuned. When i input the last 7 digits of VIN into MHD, it says it has Flash license and St2 Map

You can only take the owner at his word unless he is willing to connect MHD and show you the current MHD status on the car. I would ask that he remove MHD and return to stock before you purchase as MHD is VIN and e-mail locked - no transfer option.

So the guy modded the car to essentially a FBO, bought the MHD license... but then never loaded it? YEAH RIGHT!

as dmckmc said, if he claims it has stage 2, it was flashed, the licenses are non transferable, as such, it needs returned to stock on the DME, and you will need to purchase your own license.
