BMC Filter and ECU Update from 30.2 to 32.1

So - I just recently had a 10K warranty tune-up. I ordered a BMC filter (stock replacement, not dual cone) to install post tune-up.

First, I was surprised how much better the car performed post service. Amazing how dirty an air filter can become in one year.

As a point of comparison - I immediately (OK two days later) installed the BMC filter. Some people have questioned the efficacy of BMC filters because there was no baseline stock (and new) air filter comparison (search BMC threads).... I can say - 1) BMC performs BETTER. I havn't dyno'd the thing, but I can estimate at least the 10hp (at least) claimed improvement (as per most posts). Also, 2) engine is a touch louder. Overall engine seems to breathe much better (with Dinan Stage 3). NO BS.

Definitely worth the $85 (and shipment from Milan).

Side note... I have a March '08 E93 with an MSD 81 ECU. I asked to be updated to ECU update 32.1 I was refused, sighting that the upgrade to 32.1 was not "critical". It was confirmed that my ECU software was 30.2.1. According to the dealer, anything post ver. 30 does not warrant a "critical" update, so they would not update the software. Thoughts?

Another note... I have seen some confusion as to whether the Dinan flash is a complete overwrite or a partial overwrite of the stock software. My thoughts were - have the dealer do the flash then send to Dinan.

First - can anyone confirm whether Dinan does a complete overwrite or not?

Second - the dealer said that Dinan will NOT perform a software update unless there is a critical update from BMW. Note: the Dinan has updated its software (in line with BMW) many times since my install 6-9 months ago. Pretty s&*y that I paid many $$ for Dinan software and they won't update it (on demand) even if I am willing to pay a nominal "upgrade fee". Again - thoughts? Solutions?

1. Dinan does a complete overwrite, as they update their own software based on the latest BMW software.

2. I don't know about that 'post ver.30' statement, but I had mine done free of charge last week. Last update I had was June 08.

That shouldn't be the case. My Dinan dealer upgrades my software whenever I ask. Hell, just last week I drove up to the dealership and asked them to install the BMW software which specifically addresses the turbo lag, then install the latest Dinan software over it (the Dinan tech receives a new version every month).
They installed it with no problem and I drove my car home the next day, he didn't even charge me!

As far an "upgrade fee", I've only had to pay $100 dollars everytime I'd had the software put on before, and recently they just started doing it for free.
Which Dinan dealer are you working with? Honestly, they sound like assholes.

^ You had to pay $100 to upgrade previously? You shouldn't have to pay anything. Weird.
