BMW Stealer Taking the Micheal Now!!

Hi Guys

Warm hello to all the readers out there.. to say im fuming is an understatement after visting the local stealer!!

I have a new 3 series face lift on order ordered earlier in feb, before i placed the order was told that i could have the car by end of march!! though great just under 5 weeks good news!! rang a few weeks into march and still told the same thing march but a possibility of april now..so last night thought i would pop into the stealer and guess what the arrival date is now MAY!! however the stealer saying oh but we will def get it through before then, just like the "we will have it in march "

so it shows a 1200 status which is due to go into build..that has been like that since early march

So after taking the deposit i questioned and said well look i cant wait until then (may) to have a car and what would be my options to be.. simply told sorry you lost your depoist and if you cancel thats up to you sir!!

is bmw customer service that diabolical that they have no alternatives ?

The frustrating thing is to be told by the sales person sorry nothing i can do i cant even ring up anybody..its built when its built

so have any of you guys gone through a similar experience? and if so what are my options as the stealer has my deposit and it seems every week my order goes backwards!!

Name and shame man, which dealer/franchise is this?

Bloody joke if you ask me. Do you have it in writing that it would be ready by end of March? If so I would tell them to go screw.

You explicitly told them that you couldnt wait and needed a car before a particular time, sounds to me like they only made the sale because they assured you that it would ready in March...

I'd be kicking up a fuss, in the dealers and in front of other customers. I would also write a letter of complaint to BMW UK.

Don't give these fuckers an inch either way, they charge an arm and a leg and think they can pull the rug from under you when it comes to service. I think not.

EDIT:

Just re-read actually, sounds like you paid the deposit BEFORE asking about the delivery date?

If you signed an order from with the delivery date on it as March, you have a case, if not, you dont - Simples!

Just would like to add that i paid depoist ONCE i was told by the person that the car would be ready by end March they have dealt with me before and having purchased a few bmw's from there (& stuck to their word) i thought great, so in hindsight didnt get it in writing..however i was assured end of March

Just had a look on the order sheet (new vehicle contract) i was provided..it says est delivery 30/03/2010

Just spoke to the stealer now and says that i should wait until Monday and see if the "status " changes and that a "car can be buillt in 36 hours" so every chance i could get it end of march which is HIGHLY doubtful in my eyes!!

That is good then, as there is a date there and they are not keeping to their side of the contact, and the salesperson verbally told you end of march, which is just as binding, you have a case, that they need to answer. Ask them to supply a loan car at the very least, or cancel and ask for your deposit back, which you would be entitled. Good luck

Of course there is that chance but in the meantime it helps to know the facts and it helps others make informed choices, which is what forums are all about...

I seem to recall that on the order forms it says something along the lines "we reserve the right to change delivery dates and still hold onto your deposit etc." (I'm paraphrasing, but its a bit like the small print on British Rail tickets - i.e. we don't guarantee to get you anywhere to any timetable).

Thats not to say it isn't part of the contract that you can change during negotiations and labour the point about delivery and make it clear you want your deposit back if its x weeks late, but if you didn't your case maybe weakened by their paperwork. That said if the car is really going to be 2 months late, then the fact that they are giving crap service should kick in and allow you to wriggle out with BMW GB help if needs be.

Have you looked at getting your spec earlier through other dealers?

If it says its an estimated delivery date then they have wiggle room, you sould have asked for it in writing and what they would do to help if it didnt turn up on time.

What model is it E90/91 or E92/93 i know some cars have just fell back a build week or two.
