Best way to have Dealer upgrade DME for FREE

What's the best way to have the Dealer upgrade the DME software version for free?
I asked my SA and he told me either I have to pay or they have to find something wrong. i'm still running on the Progman.

Just complain of bad drivability at times. Or say that you noticed that your car is "laggy" It doesn't hurt to mention that you had a friend with the same issue and the problem was solved by updating this dme software.

Seriously though, the dealership is pretty quick to update software usually. I'm surprised that they are holding out on you.

OK. I'll try that when I go in for my front brakes replacement. Light just turned on.
In the past I asked him to upgrade me but I never mentioned that I had any problems. Then I never mentioned it again on my next visits after hearing that the upgrade will decrease performance or add lag to our cars.

Got mine updated by mentioning the SIB for "delayed engagement" with the auto transmission. Didn't get any pushback at all.

there are a couple of reasons that the dealer will not do the upgrade...

1) if the upgrade is "requested" by the customer with no associated problems, then any claim submitted to BMW would be rejected for no repairs required. Dealer wind up paying the tech, or the tech gets charged back. that whats called a loss...

2) if the customer indicates there is a problem, and there is NPF(no problem found) -- then no upgrade will be performed ... and then the customer is on the hook for the diagnostics.

but if there are problems found that require the I-Level update, then BMW is satisfied and the customer does not get charged .... and everybody is happy... if any of the above does not occur then one of the parties involved will be unhappy. (supposing the car is still under the 4/50k warranty or the CPO coverage is intact)

if the upgrade is real important to you, then you may want to check the piggy bank for spare change -- thats the only sure way to get it done (if there are no problems with the car, that is ... )

through your key read at time of check in, the box indicating there is an I-Level update will be checked(automatically) and this just my get you what you need. especially if there is hint of a problem on the car ....

Correct me if I'm wrong...but doesn't the PRE 29.2 software LACK the Tuner-Codes? Wouldn't one want to stay Pre 29.2 to avoid the possible tuner codes?

That would be the case if you don't have a tuning solution that handles code clearing properly. This isn't the case with the OP

That is the version of ISTA/P used to program it - but not too useful to the end user. If you literally just had it done, it should definitely be v38, if they had slightly old data it would be 37.2. Doubt it's any earlier than that.

Insist your CD player keeps not ejecting CD's or reading certain Cd's. If they replace the radio module they have to reprogram the car to the latest software.

when software is released for revision there is a modular structure to the whole package.

the UI for diagnostics and programming are the containers ie ISTA/P or ISTA/D with versions like 2.18 and up --

since the overall program is used with numerous cars, each of the selectable configurations will deploy a set package(s) of software for the specific car.

now each one of these packages are referred to as integration levels. those numbers are usually preceded by E** (**60-65 89x) or F** (01 001 010)
these are platform specifc and highly configurable based on equipment

so if you were programmed with system version 2.20 - that would mean your integration level is most likely 2.38 at least and I-Level E89x-10-06.500 or so.

New ISTA 2.21 is forthcoming

Why not? My CD player kept not ejecting CD's and they replaced it. When they code the new unit, they do a full system recode and upgraded my software.
