Buying and Selling an iPhone

So my mom is eligible for an upgrade but doesn't need it. I wanna get an iPhone 4 and sell it on ebay. How can I get it without getting the data plan or deactivating her old phone?

Thanks!

Yep, I went in to buy one because I was going to sell my unlocked 3GS for $300ish, and pay $200 for the 16gb iPhone 4.

Thinking I was gunna upgrade and make $100 profit...Too good to be true. Motherfuckers wanted to add 2 years onto my current contract, or $700 or something for an unlocked one.
