parking fine in carpark need help private firm
had a ticket come thou the post today saying i parked in there carpark at 17.30 and left 21.00 as the anpr camera caught my car as it come in and out, so i was over there free 2hr limit,letter looks like police letter but its not, fine is £40 pay within 4 days or £110 over, the company is called park eye that controls the area, the carpark is a private carpark with pc world comet and lots of other stores,done a few searches and most forums say leave it and i will get lots of bad letters then they go away and it wont go to court as they have to prove the driver,
what do u think i should do leave it and wait or pay £40 to these scammers |

Was the car park bulging at the seams or half empty. If the latter, there was no economic loss to the owners, so it is a rip-off. Ignore.

Or thank them for their note, as your vehicle was in for service at the local BMW dealership at the time and date in question. Would they mind their video evidence being submitted in support of an action you plan to take against the BMW dealership. LOL |

Me and the missus have had a few between us, never paid. They will probably send you a letter from a solicitor threatening court action, ignore it. A private parking company has to prove who was driving, providing you don't tell them they cant. A council or police issued ticket is a different matter.

When you use a privately owned car park you enter into a contract and are bound by its terms. If those terms are not clearly stated, however, you cannot voluntarily enter into the contract because you don't know the conditions. In any case, they would need to take you to court to enforce this contractual term and any judge would find the penalty charges wholly disproportionate.
You could clear yourself of this by sending a cheque for a "reasonable" penalty (£5, perhaps) for your overstay. If they want to take you to court they would have to convince a judge why they want £40 or even £110.....

i'm guessing this is the same for all private car park charges?
i.e. tesco, b&q, pcworld etc etc.. just ignore them and they go away..?? i will admit i have paid up in the past.. it was only £25 so i sucked it up. but this is good info! |

As others have said, if this notice is a from a private parking company (i.e. not the BiB/a council) then simply ignore it.
They will send you a few more letters, just ignore every single one and they will go away. |

Don't pay. As far as I know there has never been a case of a private company taking someone to court. Don't answer any letters.

Also as stated earlier they can only fine the driver so they have to prove that you were the driver

They can't issue fines. They are a private company or individual and all they could probably do is take you to court - the small claims court; just a type of meeting where a decision is made.

When our firm was cladding the new Uni building in High Wycombe everyone parked in the Staples car park directly opposite the site - it was exactly the same get-up; you get an hour (or two, I forget) for free - after that, you're automatically fined £40.
We had guys that had 30+ of these letters - no one paid them, no one was prosecuted. I, myself, used to drive in normally, but drive out with the boot up (so the rear plate is invisible) and close it once I was out on the street - I never got a letter. If they operate along the same lines, I think you'll be safe to ignore the letter.
