N54 Engine CEL. What could it be?

Hey folks. Here is a synopsis of what is going on:

For the past two months, I've been noticing some strange things with my car. Ocassionally, after some time of driving, I would get a check engine light. The car would studder and it felt like driving a Prius that would vibrate. Stopping and restarting the car always resolved the issue. This would happen once in a while, so it wasn't a big deal to me.

Then recently, I had issues starting the car on cold mornings. When I pressed the button, nothing would happen, it would not even attempt to start the car. I first thought it was the battery, but the lights, AC, cluster etc all came on fine. Probing the battery voltage confirmed that it was not a battery issue. I also thought it could be my comfort access key dying of battery, but using my brand new spare key also did not change the situation. I let it sit, and tried starting in the evening, and it came up OK.

Then today, after having dinner, the car would start and CEL immediately came on. I restarted the car, and the car started sputtering / vibrating, and it felt like the prius again. Driving after awhile would reveal the CEL. I had to limp the car home, restarting it several times on the road.

Now I do have the PRocede V4 rev2, with July maps, and recently updated to the beta maps. I doubt the procede is the cause, but wanted to hear your thoughts. I'm thinking HPFP, but I don't know if the symptoms I have match a HPFP. Could it be the spark plugs / coils? It's been between 35 degrees and 50 degrees here with the cold front.

I have 25k miles on the car, with no other mods. only the procede since about 4k miles. My last oil change was in April at 17k miles on the odo.

Taking procede logs is probably a good idea, but I'll have to go figure out how to do that. Don't know what else I can do, but at this point the car isn't really driveable. Will likely have to remove the procede before calling the dealer next week.

Any suggestions? comments? ideas?

EDIT:

The car is a 12/07 build, a 2008 car. No software update since the car was purchased new. After several times of restarting the car after the CEL, the SES light did eventually come on.

so is it the wiring update, or is it the HPFP? any ideas? Shiv?

Possibly a similar thread found here: http://www.e90post.com/forums/showthread.php?t=458406 and confirmed a similar pattern.
I don't have the Procede harness update found here: http://www.e90post.com/forums/showthread.php?t=450494

Is your car an 08 by any chance? I have an '08 and had a SES and loss of power on the freeway 2 weeks ago. I was thinking HPFP. After pulling to the side of the freeway, I turned the engine off and restarted the engine after 2min. I remembered reading a thread http://www.e90post.com/forums/showthread.php?t=458406 and confirmed a similar pattern.

My guess: do the wiring harness update found in http://www.e90post.com/forums/showthread.php?t=450494

I think this harness update should be mandatory...

If your engine didn't even turn over in the morning (ie, starter didn't spin the engine), you have problem other than a bad HPFP. Perhaps a bad ground or a bad starter motor. The CEL/code that was triggered should give you an idea of where to look. But ultimately, it sounds like an issue that the dealership should deal with.

Nope. Bad ground with the car. There is no conceivable the Procede can make the engine not turn over with the starter. Even with no grounds or 12v power going to it.
