Here are the stats:

Sapphire black metallic

Dynamic Cruise Control

Mileage is 12,500

List price is 41,992

My hunch is that this is a little high.

My buddy has been negotiating with them for the past couple days. As of yesterday they said the lowest they would go is $40,850.

Should my buddy jump on it or keep looking? It should also be noted they say this was a loaner. In my experience they don't loan out 335s, let alone M-Sports, to the average customer so I expect it's really more of a demo car that the owner, his wife, the GM, etc drove and maybe they occasionally used it as a loaner if they were short and needed one for a good customer (likely with a 7 series who didnt drive it hard anyway).

I'd appreciate any thoughts.

My wife selling her 2010 335i Msport for $39500... We're in New Brunswick area of Jersey. Alpine White/Black Interior/Walnut Trim

In addition to the above, our vehicle includes Nav, Heated Seats (no cold weather), fold down seats, bluetooth, alarm. Does not include active steering. 14,000 miles (90% highway) with 3 years 32K miles remaining on factory warranty.

considering this car new would be about 53k i'd go for it.

It's just a tiny bit high as a purchase price. Do your own negotiation!!! They are never going to settle on a lower price if the actual buyer isn't the one they are dealing with. There's far more power in being the buyer than in being the buyer's agent. If they are any good, and your agent isn't a professional buyer's agent, they'll have your "agent" playing in their favor. If your agent is there with a limited power of attorney, it could be a bit different.

Do your own negotiation!! Tell them you'll buy at 39,000, final offer. If the seller is a BMW store, do it in person. If they don't take your offer, leave. Seriously, leave. If they let you leave, they won't sell the car at that price. If they won't let you leave, stick to your guns. They may still counter something between and 39. If they do, thank them for their time and leave. No sales manager will let a serious buyer offering a profitable price leave the store.

If they let you leave, leave, get in your car and if you really are willing to pay at the last offered price, turn around go in and accept it and buy your car.

Tony, it actually is my buddy who is buying it down there in Atlanta not him negotiating for me. He was just asking me what I thought of the price ... I'm sure he will be a member on here soon enough though .... Sparkling Graphite FTW!
