Need advice badly!!!!
I have just recently ordered at 328i. It said the production has already started and it'll be finished building on 2/16/07. Now I have learned about the 6 programmable buttons (start in March production) and also I want to add the comfort access to my car. The CA said it's too late since the car is in production. The problem is I already put 1000 for deposit when I first ordered the car. I know most likely I'll be stuck with this car....Is there anything I can do to resolve this situation and not have to give up the $1000 deposit? Any suggestion is greatly appreciated. Thank you.

The $1000 should be fully refundable unless the laws in NY are different. Do you have anything in writing that says it is non-refundable?

I'm looking at my sales sheet and it doesn't say anything about non-refunable deposit. I remember I asked my CA earlier and he said it's only refundable if the car arrives and it doesn't meet the standard (i.e. scratches...) or if the car doesn't have the correct specification (i.e. wrong packages or options). Do you think I should tell my CA about the law? I'm confused.

FWIW my dealer told me when I ordered my 335 Sedan that the $1000 deposit would be fully refundable unless I ordered some wacky combo that they would have trouble selling off the lot.

I wish I was in your position. I ordered on 1/18/07 and STILL don't have a production #....don't complain that you don't have shoes, because there might be someone that doesn't have feet.

It should be fully refundable whether it's an ED or not.of all the people doing ED,it's a teeny tiny amount that need to cancel,not because of buyers remorse,but usually real emergencies.The cars are not coming out of the dealers allocation and the customer is more likely to reschedule for another time.

That's exactly what it is,a good faith commitment that gives the buyer peace of mind that they are getting that car.

So I spoke to my CA about cancelling my current order and reordering a 328i with the new programmable buttons and comfort access. Of course he was not happy to hear it because he said it's almost impossible for him to sell this car to other customers due to the fact that it's a manual transmission in the northeast. He wasn't being an ass about it, he just guilt tripped me on how he worked so hard with me to get this car and he has never sold a car to anyone at this price in his life. Here's my spec:
BMW 328i sedan manual transmission, navi, bmw assist, and heated seat. MSRP: 36445 Invoice: 33935 Price sold as: 34283 (350 over invoice) 3 years lease (10k/yr) RV:64% MF: 0.00155 Monthly payment ($425) Drive off fee: acquisition 625, security deposit 450, first month and plates (~$1800) He basically said I can get my deposit back. I do feel a little guility if I cancel my order. Did he really give me a super good deal? I know the programmable buttons and comfort access will not change the way I drive this car and I'm only leasing the car for 3 years, but i wish i knew about the march production and told him to order it after march. I ordered like a week ago and it's going to done building on 2/16 (thought people are waiting more than 2 to 3 months to be on production) Anyways, if anyone has any advice, will more than happy to hear them. Should I screw my CA over for that two features? very confused.... |

They can sell it to someone else,or even wind up trading it if it's too late to modify to an automatic.If you feel they gave you a fair deal,stay with them and let them reorder the care for later production.They're also going to be getting all of your service business,so they should be understanding,it happens.
