Insurance claim
As some will know my 335 arrived having been damaged in transit. The vendor arranged the (insured) transportation as part of the deal but says its up to me to claim against Toll. Would you agree or disagree ?

You could always try... i.e. get as many details as possible regarding the transportation, including insurance policy number if it exits, then call up Toll and see what they say.

I would have thought the insurance company would only deal with the holder of the insurance... if this is the vendor, they may need to make the call. Then you just need to take it to a repairer for quote/assessment etc. But this could be different for transport insurance.

If they are telling you it is true, I would assume it is true?
If thats what they want, do it. I wouldn't make a big fuss every step of the way. Don't sweat the small stuff. (ie; making some phone calls). If they are wrong as to whom the claimant needs to be, you will find out soon enough |

I don't think comprehensive insurance covers the car when its being transported there is no driver... It's a transport insurance claim.. then theres the question of excess

I could be wrong but I don't think it matters. Think about it if you parked the car in the street and someone hits you then you would
Still be covered, so I see no difference if it is on the back of a truck etc.... As for excess, well you know who is at fault so that should not be an issue. |

Toll have advised the damage was evident when they collected the car, and yesterday were supposed to send through some form of proof, not arrived as yet.
BTW did I mention the car has another unique feature - 3 runflats and 1 non-runflat? |

Sounds like you have a problem with the dealer there with the damage? Wtf is going on with those tyres??? I'd be getting that fixed ASAP

Errrr.. Is it a BMW dealer selling it with a single non RFT tyre? BTW the RFTs are $500 - 850 each.. generally cost much more than the tubeless.
I don't think its safe to just have 1 non RFT tyre. Traction, stopping resistance and dynamics will be out of whack esp if its in the front. EDIT: not sure if this is true.. but I think per BMW policy their cars are 'designed' for RFT, no jacks etc.. so a bit lazy of them not to spec the car 'properly'. Although they handle much better when all 4s are non-RFT |

Just an Xmas update folks, ho ho ho
the vendor says they never contacted Toll about the damage, and Toll are just saying that the car was delivered on 23rd Nov and they first heard about the issue on the 2nd December - thereby implying that the damage was done after the delivery Surely if the vendor undertook to ship the car to me fully insured as part of the deal, and I advised them on the day of delivery that the vehicle arrived damaged, then I did all I needed to, and the fact the vendor never bothered to advise Toll is their problem and not mine? speaking from my own experience having cars shipped, generally if you don't identify the damage with the courier BEFORE you sign for receipt of the car you haven't got a hope in hell of successfully claiming damage in transit.
Presuming that you have taken delivery of your car this would not be a good sign for you (but hey, this is just my experience, so you may have no issues at all)

What a Crock of Shit!!! Who's the selling Dealership? I'd be happy to go round there and smash some heads. If you told the dealer that there was an issue, on the day, its not your fault that the claim wasn't lodged for 10days. Take the matter to consumer affairs

Ouch!!! Damn I hate seeing injured beamers!
That's at min $3k of parts!! You'll need the front bar replaced as well as the under engine tray. The tray alone is $900. Hate to say this... Presuming the vendor - henceforth known as Prestige Auto Sales - won't claim against Toll , then I guess the next step is to get 2 or 3 quotes, see what my insurer thinks about it all, and get a lawyer.
BTW after nearly a month, Prestige has delivered a tyre to my home address. So I guess I arrange the fitting myself then? |
