Looking for some advice from anyone who may know more about this then me.

My sister went out a month ago and bought herself a 2006 Mercedes slk for 8.5k. She was stupid enough not to hpi it. I find out today that it has 9k finance owing on it. The finance company say it is only owing the final balloon payment. After getting through to the previous owner she tells me that she has declared bankruptcy. The twist in the story is that her now ex boyfriend sold the car and has taken off with the money!!

She is now bankrupt so what happens now. I've been looking into consumer rights acts which may help as she's 'the first innocent purchaser' etc.

Any help will be appreciated.

who did she actually buy the car off?
whos name is the car and finance in?

I suspect that unless she bought it from the financee (sp) and therefore RO she cannot be called the first innocent purchaser as she didn't purchase it from the owner

She bought the car off the women's boyfriend. The car was registered to the women who owes the finance. She had already paid 22k of it off and was bought from Mercedes dealers. Money is owed to Lombard.

The woman is very helpful with everything and is 100% bankrupt. Not too sure about the boyfriend running away either to be honest, just a way to keep money away from the banks.

I ran a hpi check on it as she just told me she didn't do one.

Not saying it would be totally impossible, but how could a person get all hold of all the keys, documents whilst also advertising it and allowing viewings without her noticing?

Then to say she is bankrupted and he has done a runner I think someone is telling a few porkies.

She has all the documents, keys paperwork etc. She wanted him to sell it for her but never expected him to disappear once it was sold. She said she was at work when it happened.

You said in the original post he sold it without her knowing.

This story is getting more confusing as even you are contradicting yourself.

Unfortunately I'd be surprised if there were any other options available for your sister other than pay the rest of the finance off or hand the car over to the finance company.

That really is a horrible situation and I really do feel for her.

The woman obviously knew on the day that she had been done over. But the car would've most likely been repossessed anyway as she was going through bankruptcy.

This is odd.

A typo is a typo but you explained pretty well that he sold the car without her knowledge then he run off with the money. You were pretty clear on the circumstances.

How come you know so much about the fiance too?

Surely the finance company would not hand out the information to anyone but the owner or someone approved by the owner?

You aren't up to something dodgy?

Sounds incredibly dodgy,very convenient for the boyfriend to go awol,when any income that the now bankrupt woman receives needs to be declared.

Has she (bankrupt) reported it to the Police,if not, I suggest you or your sister does.
To my mind the boyfriend has stolen the money from your sister, as the car was not his to sell,and is now worth nothing as the car belongs to Lombard,something I'm sure the boyfriend knew!

I've never been bankrupt but surely to be declared bankrupt you must be unable to pay your debt for a reasonable period of time?

Surely by that stage the finance company would have been involved?

I appreciate your help but pointing fingers at me is a bit out of order. I originally wrote he sold the car and took off without her knowing. My mistake as she wanted to sell but obviously expected the money too.

When you hpi a car the finance details all show up. The cars in my sisters name so is not just an anybody. Like I also said the women is more then cooperative.

I also agree that the boyfriend but sounds very dodgy. It does sound like theft on his part but he did have permission to sell it by the owner. Also she can't get into contact with him so god know if hes details were even real and is therefore untraceable.

Strip the car to pieces, sell them on eBay, pretend it never happened - tell the finance company to chase the owner, cut your losses.

Honestly dude, there is sometimes just no advice for stuff -crime happens, there are victims and it sounds like your sister is one.

Just to clarify then,

You sister bought a car off someone she did not know. She did not even meet the person selling the car, it was a person on her behalf.

She trusted this person who was selling the car on behalf of someone else enough to hand over £9k cash without doing any simple checks.

Suddenly after a month you find out the car has finance on it.

In that month she went bankrupt and the boyfriend done a runner with the cash and did not bother to report it.

The woman has obviously not reported it stolen as the police would come around to your door. It is stolen though as the guy had no consent to take the money for the item.

It's part of a crime no matter how you view it.

That is a pretty far fetched set of circumstances.

As I also said you error was pretty glaring too.
