Belt Prkway - watch out!!!

so this morning i got pulled over going 74 on 50 zone on belt by erskine.
its 6pt ticket

i should have known better since its the end of the month but i never saw any cops on belt.

any1 can recommend a traffic lawyer, its one ticket that i got from cop.

6pts ? how come ? if its your first offenec try to deal with procecutor , you might pay more but points could be taken off.

He got pulled over in Brooklyn so he's screwed, you can't beat the TVB unless the cop doesn't show up or doesn't have testimony. You don't need a lawyer for that.

OP, postpone as much as you can then just go there and defend yourself, lose, and pay the money. The points impact you from date of offense not date of conviction. By postponing you shave a good two years off any insurance impact if they even care.

Also, unless you have force placed insurance, the insurance company won't even care to raise your rates unless you switch providers or change your policy.

Disagree with the lawyer part, he will lose the case but lawyer will reduce the points and in some case might even just get away with the fine and no points (if its your first offense) also if he pleads guilty with 6 points he will have to pay driver assessment fee (300 bucks) on top of points and the fine of the ticket.

Also postpone 2 times and then give to lawyer lol

The Erskine Ave straight on the Belt is a well known speed trap. Everyone should be on notice & slow down on the straight stretch.

points cannot go on your license if you get convicted after 18 months of the "DATE OF violation" , just keep rescheduling the hearing, brooklyn usually schedules the court dates like 9 months after the violation date.

Rescheduale a few times, the 3rd time might require you to pay a bond (which you get back if not guilty, or goes towards fine if guilty) but at least this lets you postpone another few months to bring it over the 18 month period.

if you get convicted after the 18 months, the points cant be put on your license, but maybe a fine. in other boroughs like staten island this can't be done since the DMV isnt as jammed and the court dates are only like 3 months away.

i contact sager lawyers on kings highway e. 17th st

he suggested make a copy of ticket, send it out with not guilty plea, wait for the court date. i have an appt july 31. w/ traffic lawyer. any mistake on the ticket can be dismiss.

matters on the cop

is it highway patrol? a good lawyer should know they typically dont make mistakes.

In Nassau county or westchester a lawyer is a good idea, TVB areas like NYC and Suffolk county dont even bother.

Driver assessment is a bitch but the lawyer will cost more and that's no guarantee either so you may be out for both if you want to go that route.

Yeah but if u get other violations in that timeframe they can still suspend you if you accumulate 11+ points in an 18 month window.

I've gotten jerked by TVB for 10 tickets in my lifetime and only 1 got dismissed because the cop had no testimony. Maybe I'm just old

yeah the belt parkway is bad. i always see the charger sitting over there. i would just pay for a lawyer.

If ur on the belt it's highway there is no end of month for them that's their job to bang out speeders. Lawyer up he will postpone it for a while the highway guys testimony is usually spot on. As for a reduction of points with the speed ur going they might reduce it to 4 depending on judge. Good luck

mike will.refer you to another lawyer in queens.as.he typically handles nc. Unfortunately NYC offers no plea agreement and you will be found guilty and given the points. Ask me how I know. Best recourse is to hire a lawyer from the rockaway dmv and have them postpone the court date as often as possible. Take the 6 hour class for the pt reduction or insurance reduction.

i have been on the belt morning , day and night i never saw a patrol on the highway even when accidents happen lol

i got pulled over by regular unmarked car, it wasnt impala or charger. he had pulled over some1 this morning.


its same bs on sunrise highway, regular cops when it comes to end of the month they hide in between cars waiting for some1 to pass by speeding. Sometimes do checkpoints at stop signs.

only highways i always spot state troopers are in southern state and meadowbrook parkway

That sucks... When I first got my M3 I was having fun on belt, heading to queens. That construction work zone right after the bridge I was doing about 90. An unmarked charger flashed his lights as he pulled out from the entry ramp. I stopped right before the work zone thou, so the ticket wasnt as bad. Since it was my first time I paid $1200 for traffic lawyer in the city. It kinda felt like he did nothing, not too sure. He went to the court on my behalf and all that bs. Long story short, ended up being guilty and 6 pts anyway.

Theres no plea bargain in NYC so its either guilty or not. The only way to beat it, as said before, is if the cop doesnt show up or lacks in testimony. You cant really argue or defend speeding tickets. I did not know about he whole postponing thing so thats good to know. Hopefully I never have to go through that again.

And interestingly enough, my insurance rates didnt go up. Thank God!

Im going to make this crystal clear,
points on dmv come off 18 months, from the date you get pulled over,
points on insurance start from the day you are convicted,
and sit for 39 months..

which means, if you pushed your case lets say for 19 months, and become convicted..
those points dont touch down on the license, assessment will.
Now you walk all happy, woo hoo, but you insurance agent will tell you,
if you were guilty 2 weeks from the date you got pulled over,
your insurance would have a lil over 2 years left before its clean.

if you are under policy now, you might be clean, but lets say you feel
you need to switch policies, then they screen DMV for sure..

Gotta say, the end of the month quota crap is exactly that craaap...its completely false..its their job to stop you for speeding and frankly it gets them out of a day of patrol in the future because they get to meet u at tvb. you were doing almost 25 over speed limit. just own up to it.

with that said, i got a similar ticket on the belt (slightly less speed, think it was 68 in a 50) and postponed twice mainly because my first scheduled appearance was 2 days before christmas. finally went to tvb and had no chance. the highway cops have their speeches down to a freakin science. you would be astonished when you hear what the cop says and you essentially have no rebutle..might just make more sense to send the lawyer, and hopefully get it reduced even by 2 points would be significant enough. gl

ticket quota isnt crap i know few police officers

i did admit i was above the speed limit it was 6am on my way to work i was cruising

i was not cutting lanes or racing with any1

i just dont want points ill pay fine with no points

sorry to hear that..there was actually a dark blue unmarked crown vic sitting on the side this morning by erskine; and also a tan unmarked crown vic sitting by the gas station by exit 11; all facing the belt parkway east.

i always slow down by erskine st; sometimes if there's not a cop(going east) sitting on that ramp by the exit..when you drive past that sometimes they hide on the entrance ramps; so i always slow down and turn my head around there to make sure..that goes for both sides going east and west.

i'd suggest getting a lawyer, yeah the points may not be active but you'd have to pay a drivers assessment, i had a friend get a ticket there in january 2011; got a lawyer for a 78 in a 50, was convicted on a 4 pt violation instead. he paid the lawyer, but no assessment and less of a fine..same happened to me by the 878; i got my ticket down to 4 points. it's kind of a toss up in the TVB, but i also got a 79 in a 50 on the hutchinson parkway while still in the bronx, and the same lawyer got that one dismissed for me.

good luck with everything..and always slow down by erskine, if you can't see the cops on the side always watch out for them hiding all the way up on the entrance ramps, they're also in the grass by exit 9 a lot and by exit 11
