NY State Speeding ticket - options

Hello all
Passing thru NY state yesterday on the way to CT and was stopped by state police.
Mind you it was snowing and he said I was doing 92 in a 65 but also said he thought his radar was not being accurate.
i was certain I was going 85 but not over 90.
So I have to mail in my plea to the court.
if I pay, do points transfer to CT?
If I contest and plea bargain, what are the conciquences?
I haven't had a speeding ticket in NY for over 5 years. (other states, yes but no points when I just paid, including CT).
The court house is 7 hrs away so I hate to be driving back there again.
BTW, there were traps every 20 min along the southern tier, it must have been quota day.

you should have had your phone on record. If he actually said he thought his radar might not be accurate and you could play it back, you would be off the hook. The fact that he wrote you up 27mph over the limit means he is going to defend that number in court.

What are the fines, penalties and points for speeding?

For non-commercial vehicles, the fines and possible prison sentences are:

Speed

Minimum fine

Maximum fine

Possible prison time



up to 10 mph over

$90

$150

not more than 15 days



more than 10 mph over - less than 30 mph over

$180

$300

not more than 30 days



more than 30 mph over

$360

$600

not more than 30 days



inappropriate speed

$45

$150

not more than 15 days



Fines increase if your are convicted of more than one speed violation in 18 months. License is revoked for 3 convictions in 18 months. Fines may vary for speeding in school zone or restricted highway. Fines are doubled in work zones.

You are looking at 6 points and a $180-$300 fine and not more than 30 days prison time.


The driver penalty points are:

MPH over speed limit

1 - 10 mph

21 - 30 mph

31 - 40 mph

More than 40 mph

In addition to the fines and penalties shown, you will have to pay a state surcharge and possibly a Driver Responsibility Assessment if you receive six or more points on your driver record during a period of 18 months and the violations occurred on or after November 18, 2004.

OK I am not a resident of NY state.
Points stay on your record for 10 years? That's worse than bankruptcy.
I haven't had a ticket in NY for a long time and I paid the fine.
If I am out of state, would they come and extradite me if I live out of state?

Maybe there was an increased cop presence because people we driving at least 20mph over the speed limit while it was snowing.

Call a lawyer in NY. Typically you can find one that will give you a free consultation that will tell you your actual options.

if you don't live in NY you don't have to go to court. Find a lawyer (in the county you got the ticket) who can take your case and mail him/her the ticket with the fees and forget about it.

i got one 22 miles over speed limit in a state i was not a resident of and that's what i did.

The points don't reflect towards an out of state license. I got a 29 over in NY but I have a VA license and no points for me.

Radar guns have to be calibrated every so often. So if his was not calibrated recently, that ticket gets thrown out. A good lawyer should get you out of this one easily.

If you were doing 92 in a 65 you got what you deserved. If you want to drive like a fool and endanger other people you should have been arrested. No sympathy at all.

Just pay the damn thing best they'll do is have you make some hefty donation to the court if lucky...How could the Court House be 7 hours away?? Where in N.Y.do you live Buffalo?? I live in Ct. by the way. Good luck though as tickets really suck.

Well I am getting an education - there seems to be a nice racket between lawyers and prosecutors.
There is a list a mile long of firms that specialize in getting tickets reduced in NY State since there are a ton of fees that don't do anything other than drain your wallet.
DML I live in your neighborhood, I was about 5min from the PA border.

evidently so...

the OP stated he was going 85 MPH - while it was SNOWING!


...always a good idea to drive as fast as possible in the snow - was it dark too?

The following information was obtained from a fellow friend and NY state Trooper

NY NJ and PA Follow the Tri-State agreement regarding points transferring to the appropriate state of Driver. CT is not part of this, as this means the following points obtained in NY state will create a Tri-State Driving record and if you so happen to go over 12 Points and your driving privileges in the Tri-State Areas will be Suspended until A) you take the appropriate drivers defense courses B) Pay lawyer to fight the tickets so you don’t get the following points …. ( People just file Guilty and simply pay so they points anyways).
Issues that can happen if you are suspended in the tri-state and get pulled over, Arrested, Car Towed, Large Fines and Big Headache.

So hopefully I answered your question.

Just lawyered up today for the ticket. I travel in NY alot, I don't need the hassle with points.
BTW I grew up driving in snow, it doesn't freak me out like 90% of the people in the tri state area. I have driven across PA and NY with snow up to the wheel wells. The reflective markers on the side of the road make great guides.
