Yeah, this is complete BS. the dealer has no clue so they are following a checklist which in turn has made you to cough up the $$$. Call BMWNA and tell them you will file a complaint with the FTC and Attorney General's Office (Consumer warranty). The dealer has to prove the part in question failed due to your mods. This is not very simple...they cannot just state it.

FYI...I had a similar problem with a dealer who refused to replace my tie rods b/c of my aftermarket coilovers and sway bar. The dealer actually wrote "aftermarket suspension is the cause for the tie-rod failure" on the work order. I called BMWNA, we discussed the Mag-Moss Act and the Illinois Attorney Generals office and that I would make a formal complaint. BMWNA was going to reimburse me for 1) tie rods 2) airfreight cost. However, I sold the car (135 - was already up for sale) and BMWNA said they would help the new owner if he runs into the same issue in his State.

Yup, makes sense to me. If you chose to risk it going in with mods then they can deny you warranty. Obviously they got pissed off of you repeatedly complaining.
Try another dealer and take off your intake.

Would going to another dealer really help? Isn't the current status of the car in the BMW warranty/service system?

What boost are you running?

We mod our cars to make more power, this adds heat and reduces the life of components - especially turbos.

Its the risk you take, dont expect bmw to pick up the bill. Pay to play...

He apparently had no tune so stock boost.
I find it hard to believe people have mods without a tune on this car.
